Rules for providing the "Socketify" service from LLC “Instek”

  • 1. Terms and definitions

    • 1.1. Service – "Instek" LLC, registered at the address: the city of Kyiv, 04205, Kyiv, Obolonsky district, OBOLONSKY AVENUE, building 16-E, apartment 191.

    • 1.2. Smart outlet – the equipment with which the provision is made Services.

    • 1.3. The owner of the place of provision of the service is a legal entity or an individual who installed a  Smart socket and connected it to its own power grid.

    • 1.4. Internet site – the Internet resource of the Service, which is located at https://socketify.net/.

    • 1.5. User – any person who has registered on the Internet site or in Mobile application.

    • 1.6. Mobile application – software designed to run on smartphones, tablets and other mobile devices, with which the User can manage the Smart socket and receive information about the provision of the Service.

    • 1.7. Service – the service of intelligent management of Smart sockets by the User using the Service's software, which includes:

  • - provision of information on the status of Smart sockets;

  • - reservation by the User of a separate Smart socket for a certain time on a certain date;

  • - providing the User with payment information;

  • - functioning of the User support service;

  • - other services.



  • 2. General provisions

    • 2.1. The rules determine the terms of service provision and the procedure for concluding an electronic contract between the Service and Users regarding the provision of the Service. According to the legislation of Ukraine on e-commerce The Rules together with the tariffs for the provision of the Service are an offer (offer) to the Service to provide the Service to a person who agrees to enter into an electronic agreement with the Service service provision agreement. Answer (acceptance) about consent to the conclusion of electronic of the contract for the provision of the Service must be provided by performing actions that are considered by accepting the offer to conclude an electronic contract on the provision of the Service. Such actions are registration by a person who wishes to enter into an electronic contract with the Service providing the Service.

    • 2.2. The Service is obliged to conclude an electronic contract on the provision of the Service on the terms Rules with each person who accepts the offer of the Service, except those persons with whom the Service previously concluded an electronic contract on the provision of the Service, however it was terminated at the initiative of the Service, as well as in other cases specified By the rules.     • 2.3. The content of the Rules and tariffs for the provision of the Service are determined by the Service independently.   • 3. Tariffs, payment procedure and ordering Services

    • 3.1. In order to start receiving the Service, the User must use the Internet site or install the Mobile application, register, then log in and place an order for Services. 

    • 3.2. If necessary, the User, using the functionality of the Internet site or Mobile application, can book a separate Smart socket. Within 15 minutes from the moment making a reservation, the reserved Smart socket cannot be used by anyone by a person other than the User who made the reservation. Tariffs for the Service can be provided for charging a separate fee for the reservation. In the event that such a charge the established payment of the reservation must be made before the provision of such service (payment is carried out at the moment of activation of the reservation service using the functionality Internet site or Mobile application).

    • 3.3. If it is necessary to charge the batteries of the User's electric vehicle, the latter, having made sure that the corresponding Smart socket is free, connects to it and with the help of the functionality of the Internet site or Mobile application carries out order (activation) Services.

    • 3.4. Payment for the charging service is made by the User to the account of the Owner of the place service provision.

    • 3.5. The use of the Smart socket is discontinued: 

  • - automatically at the end of the rental period;

  • - in case of termination of use of the Smart socket by the User (with the help of the Internet website or Mobile application);

  • - automatically after 5 minutes from the moment of termination of electricity consumption by the User or as a result of disconnection from the Smart socket (provided that the User has not stopped it himself before this use using the functionality of the Internet site or Mobile application).

  • 3.6. The provision of the Service does not guarantee access to the places where the Services are provided (including the cost of parking), which may be established by the owners of the respective places of provision of Services. The cost of such a fee is noted, as a rule, in itself their places of provision of Services.

  • 4. Rights and obligations of the Parties

    • 4.1. The user has the right to:

      • 4.1.1. Receive free of charge from the Service on the Internet site and in Mobile sufficient information about the Service and tariffs for its provision.

      • 4.1.2. Terminate the electronic contract for the provision of the Service at any time by any means sending a corresponding message to the Service using the Internet site or Mobile application.

    • 4.2. The user is obliged to:

      • 4.2.1. When using the Service, comply with the requirements of the Rules.

      • 4.2.2. During Registration or in case of changes by the Service to the Rules and tariffs for provision Services to get acquainted with their content.

      • 4.2.3. After finishing or interrupting the use of the Smart socket, deactivate it it using the functionality of the Internet site of the Mobile application.

      • 4.2.4. Do not abuse the Smart socket reservation service. In particular, such the situation when the User did not use the service will be considered abuse charging during the reservation time three times in a row.

      • 4.2.5. Disconnect from the Smart outlet as soon as possible after the end of it use.

      • 4.2.6. When using Smart sockets, do not use equipment that is not meets international standards or is uncertified or self-made or with modifications of the energy supply system that were not provided for by the respective the manufacturer.

      • 4.2.7. Do not damage Smart sockets, other property of the Service or its business reputation.

      • 4.2.8. Do not insert foreign objects or inappropriate connectors into Smart sockets.

    • 4.3. The service has the right to:

      • 4.3.1. Change the Rules for providing the Service.

      • 4.3.2. Refuse a person from Registration or terminate an electronic contract for provision Services with an existing User if justified (fixed Service, financial institutions, owners of places of provision of Services, etc.) grounds consider that the User has taken actions aimed at quality deterioration Services, reputation of the Service, damage to property, equipment, software provision of the Service, used stolen means of payment and/or carried out fraudulent payments or prevented other Users from consuming the Service (stole charging cables, stopped charging electric vehicles for no reason other Users, did not vacate the place of provision of the Service after the end charging the vehicle, abused the post by reservation, etc.).

      • 4.3.3. Suspend the provision of Services for the duration of preventive or repair work works.

      • 4.3.4. Terminate the electronic contract for the provision of the Service by giving notice User at least 7 days before the termination date, if the User has not consumed Service for more than 2 years in a row. In the event that within the time period from the date warning the User about termination of the contract and before the date of termination by the User will use the Service, the notification to the Service about the termination of the contract is considered by the revoked Service.

      • 4.3.5. To involve third parties in providing the Service.

      • 4.3.6. Change the location of Smart sockets, increase or decrease them quantity.

    • 4.4. The service is obliged to:

      • 4.4.1. Ensure correct accounting of the amount of Service provided to everyone To the user.

      • 4.4.2. Ensure the proper operation of the User Support Service.

      • 4.4.3. Ensure confidentiality of User data and compliance legislation of Ukraine on the protection of personal data.

      • 4.4.4. Timely update information on the Internet site and in the Mobile application regarding the cost of the Service, the locations of Smart sockets and their specifications parameters (number and varieties, their occupation, the state of the Smart socket (working/not works) in case of preventive or repair work performed by the Service).

  • 5. Personal data and other conditions

    • 5.1. In order to be able to identify the User, the latter must during Registration to provide true information about your surname, first name and patronymic (last – if available) and contact means of communication. Providing the Service with their personal data, the User gives permission for their collection and processing by the Service. Collection and processing of Users' personal data will be carried out by the Service exclusively for the purpose providing the Service and fulfilling the terms of the Rules.

    • 5.2. The Service is not responsible for the impossibility of providing the Service as a result lack of electrical voltage for reasons beyond the control of the Service, as well as voltage drops in the electrical network and their possible consequences.

    • 5.3. The service does not guarantee the quality and speed of charging in case of features, malfunctions or defects of the User's electrical equipment, including related ones with battery status, charging port, corresponding controller, electrical by the User's cable, etc., and/or in case of failure of the User's electrical equipment to receive current at the power provided by the Smart socket due to the operation of the internal

      device control system control.

    • 5.4. The service does not guarantee the possibility of access to the Smart socket in case of obstruction of the entrance to it by other means of transport or at the decision of the owner of the places of provision of Services. IN at the same time, the Service will try to provide free access to the Smart socket.

    • 5.5. The service, regardless of the circumstances, is not responsible for indirect damages and omissions benefit.

    • 5.6. The User, having agreed to use the Service in accordance with these Rules, thereby gives the Service his consent to: a) receiving calls and/or messages from the Service (sms, messages in messengers, e-mails, postal messages, messages on Internet site and Mobile application, etc.) for the purpose of providing Services or informing about other services and opportunities related to the Service; b) recording of his voice messages/statements, etc. in case of contacting the User Support Service.

    • 5.7. If the User has any claims, comments or questions regarding the provided Services, they can be declared orally during the User's contact by phone +380734501115 to the User Support Service, sent by e-mail to info@socketify.net, submitted on the website in the section Help / Feedback’ or sent in writing to the postal address of the Service.
